Myanmar: new TM law mandates refiling of existing TM and filing of unregistered TM already in use in Myanmar

With the objective of facilitating the transition from the “First to Use System” to the “First to File System”, the Union of the Republic of Myanmar, Ministry of Commerce passed an order intended for trade mark owners. 

Myanmar’s new trade mark law was enacted on October 1, 2020. As per the Revised Act, all registered trade marks in Myanmar must be re-filed under the new system.

 Also, unregistered marks already in use in Myanmar must be filed at the same time. Such filings are to be supported by documents proving evidence of use.
